Your Privacy Rights

Your privacy is paramount to M Innovations, LLC, d/b/a “Mouth.com,” (hereinafter “Mouth,” “we” or “us”).   This Privacy Policy (the “Policy”) describes the types of information that we gather, how we use that information, with whom we share that information, your choices regarding our collection, use and distribution of your information and our efforts to protect your information through our website at  <mouth.com> (the “Website”).  This Privacy Policy applies to information that we collect, and does not apply to any information that third party sites to which Mouth.com may link, or information provided to, or collected by, third parties through cookies, web beacons or other third-party technologies used during your visit to the Website. 

By using the Website and the tools and services available thereon, or by ordering from the Website (collectively, the “Services”), you hereby consent to allow us to process information in accordance with this Policy. Please also refer to our Terms of Use, which are incorporated as if fully recited herein, if you have not already done so.

This Policy is subject to change. If we materially change our information retention or usage practices, we will let you know by posting the Policy changes here on the Website, and/or otherwise making you aware of the changes. Please refer to the “Effective Date” above to see when we last updated this Policy.

Territory

We will process your personal data in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world. BY VISITING THIS WEBSITE AND THE SERVICE, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY CONSENT TO OUR COLLECTING AND PROCESSING IN THE UNITED STATES THE INFORMATION THAT YOU VOLUNTARILY SUBMIT TO US.  YOU ALSO AGREE THAT THE LAW OF THE UNITED STATES GOVERNS OUR COLLECTING AND PROCESSING OF YOUR INFORMATION.

Information Collected

We collect two types of information about persons who use our Services: (1) Information that you voluntarily provide to us; and (2) information that our Services automatically collect. We explain both below.

Personal Information That We Voluntarily Collect from You 

Mouth does not collect any Personal Information about you without your voluntary consent. You may either supply this information to Mouth when you purchase goods through our Services, when you use the Services, when you complete a survey, when you create or update an account, when you request services, or otherwise when you explicitly submit it.  Any information that you voluntarily provide to us is subject to this Privacy Policy. 

The information that we may collect from you includes:

  • Name;
  • Age or date of birth;
  • Address;
  • Phone number;
  • Username and password; and
  • Email;

While Mouth may ask you for payment card information in order to process orders, we use a third-party service provider to process that data.  Mouth does not routinely collect or store payment card or other financial information from you.  

Our Services also collect “Non-Personal Information” from you.  Non-Personal Information is information that, while it assists us to provide our services to you, does not identify you specifically.  This includes information such as your gender, the types of products that you purchased, your user history, the type of device you used to access our Services and its operating system, the pages you accessed most frequently, how pages are used, applications downloaded, or search terms entered, among other data points. 

Information That We Automatically Collect from You

Mouth uses automatically tracks Internet Protocol (IP) addresses to collect information.  An IP address is a number that is automatically assigned to your device whenever you use the Internet.

Mouth’s Services may also use web beacons, pixel tags, cookies, embedded links, and other commonly used information-gathering tools.  These services enable us to recognize your computer when you log in so that we can tailor information to your liking.  A “cookie” is a small file containing a string of alphanumeric characters that uniquely identifies your browser.  Cookies enable us to confirm that you have visited Mouth previously, to keep track of the status of your account and shopping cart, and to perform other necessary functions on the Services. You can set up your browser to accept all cookies, or notify you when a cookie is set.  However, if you set your browser to disable all cookies, some features of our Services will not function properly. 

Our Services may also use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, to help us analyze how users use the Services. You may be able to opt-out of Google’s collection of information. Please visit Google’s Ads Preferences Manager or the Google Analytics opt-out browser add-on for more information.  Mouth is not responsible for Google Analytics’s use of your information. 

Use of Information

Mouth’s Internal Use of Your Information

Mouth accepts and gathers certain types of information in an effort to provide you with products and the Services that you voluntarily request from us. We may also use this information to help us develop and improve or our Services, fulfill your requests, inform you about our offers that you request, tailor our Services to meet your interests, and for other purposes permitted by law. We may use aggregate and non-personal information to advertise and promote the Services.

Sharing Information Collected with Third Parties, Consultants, and Affiliates

We may share your personal information with our business associates, consultants, service providers, advisors and affiliates in order for them to provide services to you and to Mouth.

While we do not collect or process your payment method, we do share it and your personal information with payment processors in order to process your transaction. Further, Mouth does provide your name and address to carriers to complete shipments to you of Mouth’s products.

Mouth may disclose the information that we collect from you to the extent that we believe it necessary to comply with the law, such as in response to a subpoena or court order, to defend a legal claim or otherwise as permitted by applicable law. Additionally, we may transfer your information to successor in interest, which may include but may not be limited to a third-party in the event of an acquisition, sale, merger or bankruptcy.

Links to Other Websites

Our Services may contain links to other websites. We are not responsible for the terms of use or privacy practices of such other websites or affiliates. When you leave our Services to visit another website or application, please read the privacy statements of websites that may collect personally identifiable information. This Privacy Policy applies solely to information collected by Mouth through the Services.

“Do Not Track” Signals

At the present time, outside of the Website, except as otherwise provided in this Policy, Mouth does not track your movements over time and across third-party websites. However, Mouth’s host at Shopify.com and our analytics providers, such as Google Analytics, may do so, in accordance with their own privacy practices.  For more information, please consult the Terms of Use and Privacy Policies for Shopify.com.

Security

We employ procedural and technical safeguards to keep your information secure, and protect it against loss, theft, alteration, and unauthorized access, use and disclosure.  Mouth uses a “Secure Sockets Layer,” or “SSL,” which is the industry standard security protocol for encrypting links between our Services and your browser.  Our use of SSL ensures that the data that you transmit to us remains encrypted.. We also employ other security procedures to protect your information from unauthorized access by users inside and outside the company.

Regardless of all of Mouth’s precautions, no transmission of data over the Internet is ever completely secure.  Third parties that we do not control may intercept or access transmissions or private communications unlawfully. While we strive to protect personal information, we cannot guarantee, ensure or warrant the security of any information you transmit to us. 

Access and Control

You can access your Mouth.com account to update your account, and change your username, login and your shipping information at any time.

E-Mail and Electronic Newsletters

We may offer electronic newsletters and e-mails concerning promotions, new products and services, or other marketing materials as a service to our users. You may receive newsletters and e-mails concerning promotions and marketing of ours, after you register through with the Services.  If, after you have received a message, you no longer wish to receive such materials, you may opt-out by following the unsubscribe instructions included in each electronic newsletter and e-mail. 

Children and Privacy

We do not knowingly permit users to register for our Services if they are under 18 years old, or 13 years old, with the explicit consent of their parents.  We therefore do not request personally identifiable information from anyone under the age of 18, or age 13  without parental consent.  If we become aware that a customer is under the age of 18 and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information from our files.  If you are the parent or guardian of a person under the age of 18 who has provided personally identifiable information to us without your approval, please inform us by contacting us at the e-mail address below and we will remove such information from our database.

Notwithstanding the foregoing, pursuant to 47 U.S.C. Section 230 (d), as amended, we hereby notify you that parental control protections are commercially available to assist you in limiting access to material that is harmful to minors. More information on the availability of such software can be found through publicly available sources. You may wish to contact your internet service provider for more information.

Your California Privacy Rights

If you are a resident of California, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Mouth.com to a third party for the third party’s direct marketing purposes.  This right granted to California residents apply only to their activities within the State of California. To make such a request, please contact us at info@mouth.com with "Request for Privacy Information" in the subject line. In your request, please include sufficient detail for us to locate your file.  At a minimum, please include your name, email address, and username, if any.  We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing.
